At a regular meeting of the Board of Commissioners, Montezuma County, Colorado, held on Tuesday January 16, 2024 at the Montezuma County Administration building in Cortez, Colorado, there were present:

CHAIRMAN CANDELARIA opened the meeting of January 16, 2024 with the Pledge of Allegiance

 

MINUTES: Commissioner Koppenhafer moved to approve the Proceedings of the Board of County Commissioners of Montezuma County, for Tuesday, January 9, 2024 as presented.  Motion was seconded by Commissioner Lindsay and carried.

 

PUBLIC HEARING: It being the time set aside a public hearing is held for review and determination regarding a proposed Subdivision Amendment & AR10-34 Rezoning Application to Lot #12 of the Summit Lake West Unit II Subdivision submitted by Ruth Mathis & Betty Toso, on property located at 14438 Road 34.7, Mancos, CO, consisting of 39.74 acres, more or less, located south of Hwy 184, west of Road 35.6, situated in Section 32, Township 37N, Range 14W, N.M.P.M.  The roll was called, the public notice read, and the proceedings were recorded for the record.  Ms. Mathis was present.  Planning Director, Don Haley along with Assistant, S. Jane Duncan presented the details of the application and the findings of the Planning and Zoning Commission.  Commissioner Candelaria opened the hearing to public comment.  Public comment was made by Bruce White.  Hearing no further public comment that portion of the hearing was closed.  After hearing all the evidence presented Commissioner Lindsay moved to accept the proposed Subdivision Amendment & AR10-34 Rezoning Application to Lot 12 of the Summit Lake West Unit II Subdivision submitted by Ruth Mathis & Betty Toso, on property located at 14438 Road 34.7, Mancos.  Second by Commissioner Koppenhafer and carried.  Commissioner Candelaria closed the hearing at this time.  (See attached)

 

PUBLIC HEARING: It being the time set aside a public hearing is held for review and determination regarding a proposed Subdivision Amendment Application to the Van Horn Subdivision & Boundary Line Adjustment, submitted by Fiona King, on property located at 17380 Road G, Cortez, CO, consisting of 4.41 acres, more or less, and Greaves/Larsen Family Trust, on property located at 17374 Road G, Cortez, CO, consisting of 25 acres, more or less, both located south of Road G and west of Road 21, situated in Section 33, Township 36N, Range 17W, N.M.P.M.  The roll was called, the public notice read, and the proceedings were recorded for the record.  Ms. King was present.  Planning Director, Don Haley along with Assistant, S. Jane Duncan presented the details of the application and the findings of the Planning and Zoning Commission.  Commissioner Candelaria opened the hearing to public comment.  Hearing no public comment that portion of the hearing was closed.  After hearing all the evidence presented Commissioner Koppenhafer moved to approve the Van Horn Subdivision & Boundary Line Adjustment, submitted by Fiona King, on property located at 17380 Road G, Cortez, CO, consisting of 4.41 acres, more or less, and the Greaves/Larsen Family Trust, on property located at 17374 Road G, Cortez, CO, consisting of 25 acres, more or less, situated west of County Road 21 and south of Road G.  Second by Commissioner Lindsay and carried.  Commissioner Candelaria closed the hearing at this time.  (See attached)

 

PLANNING: Planning Director, Don Haley along with Assistant, S. Jane Duncan presented for signatures a Mylar for a 2 Lot Moderate Subdivision and AR3-9 Rezoning submitted by Robert & Katherine Heyder Living Trust; agent: Benjamin Bradford Shaw, on property located at 12064 Road 40, Mancos, CO, consisting of 12.85 acres, more or less, located east of Road 40, north of Hwy 184, situated in Section 8, Township 36N, Range 13W, N.M.P.M.

 

PUBLIC HEARING: It being the time set aside a public hearing is held for review and determination regarding a proposed 2nd Amendment to Lot 1 of the Lichliter 2 Lot Moderate Subdivision, submitted by Kathleen Turner, on property located at 25695 Road M, Cortez, CO, consisting of 7.34 acres, more or less, located west of Road 26, north of Road M, situated in Section 11, Township 36N, Range 16W, N.M.P.M.  The roll was called, the public notice read, and the proceedings were recorded for the record.  Ms. Turner was present.  Planning Director, Don Haley along with Assistant, S. Jane Duncan presented the details of the application and the findings of the Planning and Zoning Commission.  Commissioner Candelaria opened the hearing to public comment.  Hearing no public comment that portion of the hearing was closed.  After hearing all the evidence presented Commissioner Lindsay moved to approve the proposed 2nd Amendment to Lot 1 of the Lichliter 2 Lot Moderate Subdivision, submitted by Kathleen Turner, on property located at 25695 Road M, Cortez, CO.  Second by Commissioner Koppenhafer and carried.  Commissioner Candelaria closed the hearing at this time.  (See attached)

 

PUBLIC COMMENT: No public comment was made.

 

UNFINISHED BUSINESS:

RESOLUTION: Resolution #3-2024, a Resolution Approving a Comprehensive Economic Development Strategy for Region 9 was presented for approval.  Commissioner Koppenhafer moved to approve Resolution #3-2024, a Resolution Approving a Comprehensive Economic Development Strategy for Region 9.  Second by Commissioner Lindsay and carried.  (See attached)

 

DISCUSSION: The proposed LOR Foundation Grant funding request for Community Emergency Response Team Training was presented by Emergency Manager, Jim Spratlen and Grant Coordinator, Robert Dobry.  Commissioner Lindsay moved to approve the application for the LOR Foundation Grant funding request for Community Emergency Response Team Training.  Second by Commissioner Koppenhafer and carried.  (See attached) 

 

APPOINTMENT: An application from Mary Holaday to represent Montezuma County on the Area Agency on Aging (AAA) Board of Directors was received.  Commissioner Koppenhafer moved to appoint Mary Holaday as a representative for Montezuma County to the Area Agency on Aging (AAA) Board of Directors.  Second by Commissioner Lindsay and carried. DISCUSSION: The proposed Dell Financial Services financial documents for the VXRAIL P670F Project were presented for approval by IT Director, Jim McClain.  Commissioner Koppenhafer moved to approve the lease of a server from Dell Financial Services, with an Amortization Schedule #810-9006602-002.  Second by Commissioner Lindsay and carried.  (See attached) 

 

NEW BUSINESS:

CERTIFICATION LEVIES AND REVENUES: Administrator, Anderson presented for approval the Budget Year 2024 Certification of Levies and Revenues by the Montezuma County Commissioners, to be sent to the State of Colorado.  Commissioner Lindsay moved to certify the mills for revenues for Montezuma County, for the physical year 2024.  Second by Commissioner Koppenhafer and carried.  (See attached)

 

LIQUOR LICENSE: Deputy Clerk, Jerri Frizzell presented a liquor license renewal application for, Bubba J’S. LLC, DBA Bubba’s, located at 18806 Hwy 491, Lewis, Co.  Commissioner Koppenhafer moved to approve the renewal application for the Colorado Beer and Wine license for Bubba J’s LLC, at 18806 Hwy 491 Lewis, Co 81327.  Second by Commissioner Lindsay and carried.  (See attached)

 

LIQUOR LICENSE: Deputy Clerk, Jerri Frizzell, presented for approval a liquor license renewal application for Paragon Business Investments, LLC, DBA Hilltop Liquors, located at 27963 Hwy. 184, Dolores, Co. 81328.  Commissioner Koppenhafer moved to approve a retail liquor license renewal application for Paragon Business Investments LLC, doing business at 27963 Hwy 184, Dolores, CO.  Second by Commissioner Koppenhafer and carried.  (See attached)

 

COUNTY ATTORNEY REPORT: County Attorney, Ian MacLaren gave an update on the Kinder Morgan case and the Fair Board civil action complaint.     

ADMINISTRATOR REPORT: County Administrator, Travis Anderson discussed the Southwest Opioid Response District meeting and the attended meeting with the League of Women Voters.

 

COUNTY COMMISSIONER REPORT: Topics within the Commissioners reports included: Commissioner Lindsay discussed the viewed Cortez City Council meeting, the attended Dispatch meeting and the scheduled Montezuma Valley Irrigation meeting.   Commissioner Koppenhafer discussed the rescheduled Area Agency on Aging (AAA) meeting, the attended Mancos Town Board meeting and the scheduled Montezuma Valley Irrigation meeting.  Commissioner Candelaria discussed the beginning of the legislative session, a scheduled Fire Commission meeting and the scheduled Montezuma Valley Irrigation meeting.

 

 MOTION TO ADJOURN: Commissioner Lindsay moved to adjourn, seconded by Commissioner Koppenhafer and carried.
