At a regular meeting of the Board of Commissioners, Montezuma County, Colorado, held on Tuesday August 6, 2024 at the Montezuma County Administration building in Cortez, Colorado, there were present:

CHAIRMAN CANDELARIA opened the meeting of August 6, 2024 with the Pledge of Allegiance
MINUTES: Commissioner Koppenhafer moved to approve the Proceedings of the Board of County Commissioners of Montezuma County, for Tuesday, July 30, 2024 as presented. Motion was seconded by Commissioner Lindsay and carried.
PLANNING: Director, Don Haley along with Assistant, S. Jane Duncan presented for signatures of a Zoning Variance submitted by Bill F. Ragland & Sons, on property located at TBD Hwy 184, Dolores, CO, consisting of 156.99 acres, more or less, located south of Hwy 184 and east of Road 23.5, situated in Section 3, Township 37N, Range 16W, N.M.P.M., and Stoner Top, Inc., on property located at 23966 Hwy 184, Dolores, CO, consisting of 15.68 acres, more or less, located south of Hwy 184 and east of Road 23.5, situated in Section 9, Township 37N, Range 16W, N.M.P.M.
PLANNING: Director, Haley along with Assistant, Duncan presented for signatures of a Mylar for a Boundary Line Adjustment, submitted by Bill F. Ragland & Sons, on property located at TBD Hwy 184, Dolores, CO, consisting of 156.99 acres, more or less, located south of Hwy 184 and east of Road 23.5, situated in Section 3, Township 37N, Range 16W, N.M.P.M., and Stoner Top, Inc., on property located at 23966 Hwy 184, Dolores, CO, consisting of 15.68 acres, more or less, located south of Hwy 184 and east of Road 23.5, situated in Section 9, Township 37N, Range 16W, N.M.P.M
Director, Haley along with Assistant, Duncan presented for signatures of a Setback Variance, submitted by Barbara Benavidez, LeAnn Siglin & Kenneth Gallegos, on property located at 14852 Road 29, Dolores, CO, consisting of 11.84 acres, more or less, located south of Road 29, west of Road 29.75, situated in Section 33, Township 37N, Range 15W, N.M.P.M.
PUBLIC COMMENT: No public comment was made.
UNFINISHED BUSINESS:
RESOLUTION: Attorney, MacLaren presented for approval, Resolution #8-2024, a resolution authorizing the County Attorney to sign release to participate in Global Opioid Settlement with Kroeger. Commissioner Koppenhafer moved to approve Resolution 8-2024 a resolution authorizing the County Attorney to sign release to participate in Global Opioid with Kroger. Second by Commissioner Lindsay and carried. (See attached)
DISCUSSION: During the Monday workshop Public Health Director Bobbie Lock along with Assistant Director, Laurel Schafer presented for approval, the Class B Secure Transportation Service License and Type 2 Secure Transportation Vehicle permits from the Southwest Colorado Mental Health Center dba Axis Health. Commissioner Lindsay moved to approve the Secure Transportation Service License with Southwest Colorado dba Axis Health System. Second by Commissioner Koppenhafer and carried. (See attached)
GRANT DISCUSSIONS: County Grant Coordinator, Robert Dobry met with the Commissioners to present for approval the Colorado Department of Local Affairs 2024 Gaming Impact Grant application. Commissioner Lindsay moved to approve the Colorado Department of Local Affairs Gaming Grant application. Second by Commissioner Koppenhafer and carried. (See attached)
RESOLUTION: Attorney, MacLaren presented for discussion, Resolution #9-2024, a resolution authorizing litigation against the State of Colorado to challenge provisions of Colorado Revised Statutes related to the Severance Tax Fund. Commissioner Koppenhafer moved to approve Resolution 9-2024 a resolution authorizing litigation against the State of Colorado Revised Statutes related to the Severance Tax Fund. Second by Commissioner Lindsay and carried. (See attached)
COUNTY ATTORNEY REPORT: County Attorney, Ian MacLaren discussed Dollar General Litigation, meeting with the D.A. and Don Haley about public nuisance action on some problem properties and a PACKS corporation meeting.
ADMINISTRATOR REPORT: County Administrator, Travis Anderson discussed the Emergency CCI property tax initiative and 108 finances.
COUNTY COMMISSIONER REPORT: Topics within the Commissioners reports included:
Commissioner Koppenhafer discussed attending the County Fair and also thanked the Fair Board.
Commissioner Lindsay discussed attending the County Fair and appreciation of the Board members.
Commissioner Candelaria: Fair Board, attending the Housing Authority and Budget Committee meetings, Initiative 108, Boggy Draw Beat Down and the workshop.
MOTION TO ADJOURN: Commissioner Lindsay moved to adjourn, seconded by Commissioner Lindsay and carried.
