At a regular meeting of the Board of Commissioners, Montezuma County, Colorado, held on Tuesday September 10, 2024 at the Montezuma County Administration building in Cortez, Colorado, there were present:

CHAIRMAN CANDELARIA opened the meeting of September 10, 2024 with the Pledge of Allegiance

 

MINUTES: Commissioner Koppenhafer moved to approve the Proceedings of the Board of County Commissioners of Montezuma County, for Tuesday, September 3, 2024 as presented.  The motion was seconded by Commissioner Lindsay and carried.

 

PUBLIC HEARING: It being the time set aside a public hearing is held for review and determination of a proposed Amendment to  Lots 1 & 3 of the Adair Estate Cluster Incentive Planned Unit Development and AR3-9 Rezoning Application submitted by Kenneth & Julie Derrick, on properties located at 19424 Hwy 491 & TBD Road V.3, Lewis, CO, consisting of 28.65 acres & 3.05 acres, more or less, both located east of Hwy 491, north of Road V, situated in Section 6, Township 37N, Range 16W, N.M.P.M.  The roll was called, the public notice read, and the proceedings were recorded for the record.   Mr. and Mrs. Derrick were present.    Planning Director, Don Haley along with Assistant, S. Jane Duncan presented the details of the application and the findings of the Planning and Zoning Commission.  Commissioner Candelaria opened the hearing to public comment.  Allen Maez made public comment.  Hearing no further public comment that portion of the hearing was closed.  Commissioner Lindsay moved to accept amendment to Lots 1 & 3 of the Adair Estate Cluster Incentive Planned Unit Development and AR3-9 Rezoning Application submitted by Kenneth & Julie Derrick, on properties located at 19424 Hwy 491 & TBD Road V.3, Lewis. Second by Commissioner Koppenhafer and carried.  Commissioner Candelaria closed the hearing at this time.  (See attached)

 

PUBLIC HEARING: It being the time set aside a public hearing is for review and determination of a proposed General Planned Unit Development Application and Special Use Permit Application, submitted by Daniel Quigley, on property located at 29554 Road N, Dolores, CO, consisting of 40 acres, more or less, located east of Road 29, north of Road M, situated in Section 9, Township 36N, Range 15W, N.M.P.M.  The roll was called, the public notice read, and the proceedings were recorded for the record. Mr. Quigley was present. Planning Director, Don Haley along with Assistant, S. Jane Duncan presented the details of the application and the findings of the Planning and Zoning Commission.  Commissioner Candelaria opened the hearing to public comment.  Hearing no public comment, that portion of the hearing was closed.  After hearing all the evidence presented Commissioner Koppenhafer moved to approve a proposed General Planned Unit Development Application and Special Use Permit Application, submitted by Daniel Quigley, on property located at 29554 Road N, Dolores, CO, consisting of 40 acres, more or less.  Second by Commissioner Lindsay and carried.  Commissioner Candelaria closed the hearing at this time.  (See attached)

 

PUBLIC HEARING: It being the time set aside a public hearing  is held  for review and determination of a proposed Amendment to Lot 9 of the Summit Lake West Unit II Subdivision for AR35+ Rezoning Application, Planned Unit Development Application, and Special Use Permit Application, submitted by Dennis & Laura Williams, on property located at 35490 Road P.6, Mancos, CO, consisting of 40.20+/- acres, more or less, located south of Hwy 184, west of Road 35.6, situated in Section 33, Township 37N, Range 14W, N.M.P.M.  The roll was called, the public notice read, and the proceedings were recorded for the record.   Planning Director, Don Haley along with Assistant, S. Jane Duncan presented the details of the application and the findings of the Planning and Zoning Commission.  Commissioner Candelaria opened the hearing to public comment.  Garron Shaw and Michael Parker made public comment. Hearing no further public comment that portion of the hearing was closed. After hearing all the evidence presented Commissioner Lindsay moved to accept the proposed Amendment to Lot 9 of the Summit Lake West Unit II Subdivision for AR35+ Rezoning and deny the Planned Unit Development and Special Use Permit Application, submitted by Dennis & Laura Williams, on property located at 35490 Road P.6, Mancos. Second by Commissioner Koppenhafer and carried. Commissioner Candelaria closed the hearing at this time. (See attached)

 

PLANNING: Director, Don Haley along with Assistant, S. Jane Duncan presented for signatures for a Mylar of a Single Lot Development & AR3-9 Rezoning, submitted by Harvey & Sharon Hackett and Ted & Shauna Gray, on property located at TBD Road H, Cortez, CO, consisting of 41.32 acres, more or less, located south of Road H, east of Road 27, situated in Section 4 Township 35N, Range 15W, N.M.P.M.

 

PUBLIC COMMENT: Public comment was made by Ty Koppenhafer.

 

UNFINISHED BUSINESS:

 

GRANT DISCUSSIONS:

 

DISCUSSION: Administrator Anderson presented for review and approval the CHORE Project and Salad Bar for the Senior Center. $25,000.00 and $10,000.00 respectively.  Commissioner Koppenhafer moved to approve Montezuma County Grant Application Submission form for the Senior Services for the Senior Services Salad Bar in the amount of $10,000.00 with no cash match, from the LOR Foundation.  Second by Commissioner Lindsay and carried.  Commissioner Koppenhafer moved to accept Montezuma County Grant Submission Form for Senior Services for the Senior Services CHORE Project through the LOR Foundation, in the amount of $25,000.00, with no cash match.  Second by Commissioner Lindsay and carried. DISCUSSION: Dustin Sattler, Head of Maintenance and Jim Spratlen, Emergency Manager presented bids for new generators.

 

DISCUSSION: Administrator Anderson presented for review and determination the Colorado Counties, Inc. (CCI) 2025 Legislative Committee Commissioner Designation form. Commissioner Koppenhafer moved to approve Commissioner Candelaria to be our representative to the legislative Committee Commission Designation Form. Commissioner Lindsay seconded and the motion carried. Commissioner Candelaria moved to appoint Commissioner Lindsay as alternative for the legislative committee. Second by Commissioner Koppenhafer and carried.

 

DISCUSSION: The Montezuma County Colorado Request for Proposal for Professional Engineering Services September 2024, for the Road & Bridge Hwy 184 / CR-25 Project was presented for approval.    Commissioner Lindsay moved to approve option 1 of the RFP for road and bridge for the project on HWY 184 and County Road 25.  Second by Commissioner Koppenhafer and carried. (See attached)

 

COUNTY ATTORNEY REPORT: County Attorney, Ian MacLaren discussed HB-24-1413 and the ongoing case with the state of Colorado. 

 

DISCUSSION: Commissioner Koppenhafer moved to sign a Letter of Support for the City of Cortez, MMOF funding request for a project necessary to the infrastructure on the south pedestrian pathway, that is south of Cortez.  Second by Commissioner Lindsay and carried. (See attached)

 

MEMORANDUM OF AGREEMENT: Commissioner Koppenhafer moved to sign a memorandum of agreement to Montezuma County Risk Mapping Assessment and Planning Project, Phase 2 Development.  Second by Commissioner Lindsay and carried.  (See attached)

 

ADMINISTRATOR REPORT: County Administrator, Travis Anderson discussed an attended community grants budget meeting, the completion of the Tabor language for the County Public Safety Sales Tax ballot question, the attended Corporal Spruell’s Korean War internment, the Administrators transfer of the Community Intervention Program to the City of Cortez and an attended Property tax meeting.

 

COUNTY COMMISSIONER REPORT: Topics within the Commissioners reports included:

Commissioner Koppenhafer discussed the attended Triple A meeting.

Commissioner Candelaria: discussed attended budget committee meetings, the attended SHSP stakeholder workshop for Region 5, the Monday Workshop and the attended Dolores Town Council meeting.

Commissioner Lindsay discussed the scheduled Cortez City Council meeting.

 

MOTION TO ADJOURN: Commissioner Lindsay moved to adjourn, seconded by Commissioner Koppenhafer and carried.
