At a regular meeting of the Board of Commissioners, Montezuma County, Colorado, held on Tuesday December 17, 2024 at the Montezuma County Administration building in Cortez, Colorado, there were present:

CHAIRMAN CANDELARIA opened the meeting of December 17, 2024 with the Pledge of Allegiance
MINUTES: Commissioner Koppenhafer moved to approve the Proceedings of the Board of County Commissioners of Montezuma County, held on Tuesday, December 10, 2024 as presented. The motion was seconded by Commissioner Lindsay and carried.

PLANNING: Planning Director, Don Haley presented for signatures a Mylar and Exemption Resolution, submitted by Rodney Oliver, on property located at TBD Road 17, Pleasant View, CO, consisting of 93 acres, more or less, owned by RB Oliver Farms, LLC, located north of Road AA, east of Hwy 491, situated in Section 8, Township 38N, Range 17W, N.M.P.M.
2025 BUDGET PUBLIC HEARING: It being the time set aside a public hearing is held for review and determination regarding the proposed 2025 budget. The public notice was read, the roll was called, and the proceedings were recorded for the record. Administrator Anderson presented the synopsis of the proposed budget. Commissioner Candelaria opened the hearing to public comment. Hearing no public comment that portion of the hearing was closed. Administrator Anderson presented the following resolutions for approval:
Resolution #15-2024: a resolution adopting a budget for Montezuma County, Colorado for the calendar year beginning on the first day of January 2025 and ending on the last day of December 2025. Commissioner Koppenhafer moved to approve Resolution #15-2024, a resolution adopting a budget for Montezuma County, Colorado for the calendar year beginning on the first day of January 2025 and ending on the last day of December 2025. Second by Commissioner Lindsay and carried. (See attached)
Resolution #16-2024: a resolution appropriating sums of money for 2025. Commissioner Koppenhafer moved to approve resolution #16-2024. A resolution to appropriate sums of money for 2025, for Montezuma County. Second by Commissioner Lindsay and carried. (See attached)
Resolution #17-2024: a resolution levying general property taxes for the year 2024, to help defray the costs of government for Montezuma County, Colorado for the 2025 budget. Commissioner Koppenhafer moved to approve resolution #17-2024, a resolution levying general property taxes for the year 2024, to help defray the costs of government for Montezuma County, Colorado for the 2025 budget, the County General mill levy set at 10.588, Social Service at 1.05, Road and Bridge at 2.616, for a total mill levy at 14.254. Second by Commissioner Lindsay and carried (See attached)
Resolution #18-2024: A resolution levying general property taxes for the year 2024, to help defray the costs of the Law Enforcement Authority of Montezuma County, Colorado for the 2025 budget. Commissioner Koppenhafer moved to approve resolution #18-2024, a resolution levying general property taxes for the year 2024, to help defray the costs of the Law Enforcement Authority of Montezuma County, Colorado for the 2025 budget. The Law Enforcement Authority mill will be set at 1.450. Second by Commissioner Lindsay and carried. (See attached)
Resolution #19-2024: a resolution adopting a budget for the Montezuma County E-911 Authority, Colorado for the calendar year beginning on the first day of January 2025 and ending on the last day of December 2025. Commissioner Koppenhafer moved to approve Resolution #19-2024, a resolution adopting a budget for Montezuma County, E-911 Authority, Colorado for the calendar year beginning on the first day of January 2025 and ending on the last day of December 2025. Second by Commissioner Lindsay and carried. (See attached)
Resolution #20-2024: a resolution adopting a budget for the Montezuma County Law Enforcement Authority, Colorado for the calendar year beginning on the first day of January 2025 and ending on the last day of December 2025. Commissioner Koppenhafer moved to approve Resolution #20-2024, a resolution adopting a budget for Montezuma County, Law Enforcement Authority, Colorado for the calendar year beginning on the first day of January 2025 and ending on the last day of December 2025. Second by Commissioner Lindsay and carried. (See attached) Commissioner Candelaria closed the hearing at this time.
PUBLIC COMMENT: No public comment was made.
UNFINISHED BUSINESS:
DISCUSSION: During the Monday Workshop, the Private Activity Bond allocations to Colorado Housing and Finance Authority documents were presented for signatures. Commissioner Lindsay moved to approve, the return of unused private activity bond allocations to the Colorado Housing and Finance Authority, otherwise known as CHAFA. Second by Commissioner Koppenhafer and carried. (See attached)
Resolution #21-2024: A resolution declaring the intent of Montezuma County, Colorado to delegate to the Colorado Housing and Finance Authority the Authority to issue bonds using 2021 and 2022 private activity bond volume cap in connection with financing housing facilities for low and middle income families and persons; and authorizing a delegation agreement in connection therewith. Commissioner Koppenhafer moved to approve Resolution #21-2024, a resolution declaring the intent of Montezuma County, Colorado to delegate to the Colorado Housing and Finance Authority the Authority to issue bonds using 2021 and 2022 private activity bond volume cap in connection with financing housing facilities for low and middle income families and persons; and authorizing a delegation agreement in connection therewith. Second by Commissioner Lindsay and carried. (See attached)
Federal Tax Exemption Certificate Montezuma County Colorado: Commissioner Koppenhafer moved to sign the Federal Tax Exemption Certificate for Montezuma County Colorado as it relates to the Private Activity bonds. Second by Commissioner Lindsay and carried. (See attached)
Delegation Agreement: Commissioner Koppenhafer moved to sign the Delegation Agreement; delegation agreement is made and entered in to as December 17, 2024 between Montezuma County, a public body, and the Colorado Housing and Finance Authority. Second by Commissioner Lindsay and carried. (See attached)
Certificate of Montezuma County, Colorado Concerning Private Activity Bond Volume Cap Allocation: Commissioner Koppenhafer moved to sign the Certificate of Montezuma County, Colorado Concerning Private Activity Bond Volume Cap Allocation. Second by Commissioner Lindsay and carried. (See attached)
DISCUSSION: A discussion related to the proposed use of the Beaver Rim Gravel Pit by Dolores County was held. Commissioner Lindsay moved to authorize the Administrator, to forward a letter to the Forest Service, supporting the Dolores County’s use of the Beaver Rim pit. Second by Commissioner Koppenhafer and carried. (See attached)
CEMETERY APPOINTMENTS: Letters of interest for reappointment to the Fairview Cemetery Board were received. The letters of interest will be held and the required advertising will be posted
COUNTY ATTORNEY REPORT: County Attorney, Stephen Tarnowski discussed the Road 41, Ironwood, Severance Tax, and the Dollar Store cases. Other topics discussed included, re-advertising for the Assistant County Attorney position and Child Protection cases.
ADMINISTRATOR REPORT: County Administrator, Travis Anderson mentioned conversations with Landfill Manager, Jarmon related to the Cell 5 gravel issue, a discussion with Mesa County related to Fairgrounds and 501(c)(3) exemptions, working through the CIP program and the proposed Pueblo Community College Intergovernmental Agreement regarding the shooting range. Administrator Anderson expressed gratitude to Faedra Grubb and Robert Dobry for their work on the mill levies.
COUNTY CLERK & RECORDER: County Clerk, Kim Percell discussed documents received from the Cortez Fire Protection District relating to the proposed assessment of impact fees and a conversation held, as to her roles as Clerk to the Board, that pertain to attesting documents for the Commissioners.
COUNTY COMMISSIONER REPORT: Topics within the Commissioners reports included:
Commissioner Koppenhafer discussed the attended MVI meeting, the Town of Mancos Board meeting, and the Southwest Water Conservation meeting.
Commissioner Lindsay: discussed an attended Dolores school program, the 4 Corners Board of Realtors Christmas Parade, area Christmas light displays and the attended Cortez City Council meeting.
Commissioner Candelaria: discussed a recent vacation, the NCA, the Monday Workshop and the Public Lands reports.
SUPPLEMENTAL BUDGET REQUEST HEARING: It being the time set aside a continued public hearing is held for review and determination regarding the proposed supplemental budget requests for the Sherriff’s Department. The roll was called, and the proceedings were recorded for the record. From the Montezuma County Sheriff’s office, Undersheriff Tyson Cox, Detention Lt. Vici Pierce, Admin. Supervisor Wanda Martin, Admin. Assistant Finance Kendall Allen, along with, Robert Dobry from County Finance were present. Commissioner Candelaria reported that at this time the Board of County Commissioners has not approved the supplemental budget request for the Sheriff’s Office. If necessary, they will approve the supplemental budget at the last Board of County Commissioners meeting of the year, to ensure that the General Fund as a whole is not overspent. Commissioner Candelaria closed the hearing at this time.
RESOLUTION #22-2024: Administrator Anderson read Resolution #22-204, a resolution censuring Montezuma County Sheriff Steve Nowlin for expending funds beyond appropriation. Commissioner Koppenhafer moved to approve resolution 22-2024, a resolution censuring Montezuma County Sheriff Steve Nowlin for expending funds beyond appropriation. Second by Commissioner Lindsay and carried. (See attached)
EXECUTIVE SESSION Pursuant to Attorney Tarnowski’s recommendation, Commissioner Lindsay moved to go into executive session for a discussion of specialized details of security arrangements or investigations under C.R.S. Section 24-6-402(4)(d). Seconded by Commissioner Koppenhafer and carried. Included in the session will be; Commissioners Candelaria, Lindsay and Koppenhafer, Administrator Anderson, Attorney Tarnowski and members of the Montezuma County Sheriff’s Office. Commissioner Lindsay moved to go out of executive session, seconded by Commissioner Koppenhafer and carried. (See attached)
