ORDINANCE NO. 3-2014
PROHIBITION ON THE OPERATION OF MARIJUANA CULTIVATION FACILITIES, MARIJUANA PRODUCT MANUFACTURING FACILITIES, MARIJUANA TESTING FACILITIES, AND RETAIL MARIJUANA STORES IN MONTEZUMA COUNTY, COLORADO, EXCEPT WITH IN THE CORPORATE LIMITS AND AUTHORITY OF THE CITY OF CORTEZ, THE TOWN OF DOLORES, AND THE TOWN OF MANCOS

WHEREAS, COLO. CONST. art. 18, § 16(5)(f}, authorizes a locality to prohibit the operation of marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, and retail marijuana stores; and

WHEREAS, Colorado Revised Statutes §30-11-101(2) authorizes Counties 1o exercise powers regarding health, safety, and welfare issues; and

WHEREAS, the Montezuma County Board of Commissioners conducted a public hearing on June 30, 2014, to consider the following, and finds:

NOW THEREFORE BE IT ORDAINED by the Montezuma County Board of Commissioners, under COLO. CONST. art. 18, § 16(5)(f} and C.R.S. §30-11-101(2), that it is prohibited to operate marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, and retail marijuana stores in Montezuma County, Colorado, except within the corporate limits and authority of the City of Cortez, the Town of Dolores, and the Town of Mancos.
