RESOLUTION APPOINTING ZONING OFFICIAL FOR MONTEZUMA COUNTY. COLORADO

WHEREAS, the Montezuma County Board of County Commissioners is committed to enforcing provisions contained in the Montezuma County Land Use Code; and,

WHEREAS, mechanisms available to enforce the Montezuma County Land Use Code include the imposition of civil penalties, including fines, pursuant to Colorado Revised Statutes (C.R.S.) 30-28-124.5; and,

WHEREAS, C.R.S. 30-28-124.5 requires a “county zoning official designated by resolution” to provide violators of a county land use code with written notice of a violation prior to the commencement of any court action; and,

WHEREAS, Don Haley is currently employed as the Planning Director for Montezuma County and in such capacity, is required to ensure that properties and property owners within Montezuma County conform with the mandates set forth in the Montezuma County Land Use Code;

NOW, THEREFORE, IT IS HEREBY ORDERED, by the Montezuma County Board of County Commissioners that Don Haley, as well as any individual serving in the capacity of Planning Director for Montezuma County in the future, be appointed as a “county zoning official” for Montezuma County who is authorized to provide violators of the Montezuma County Land use Code with written notice of violations prior to the commencement of litigation as required by applicable provisions of the Colorado Revised Statutes.
