Resolution # 16-2023

RESOLUTION DESIGNATING MEMBERS OF MONTEZUMA COUNTY’S COMMITTEE FOR THE DISPOSITION OF FORFEITED PROPERTY

WHEREAS, the Montezuma County Sheriff s Department may, from time to time, obtain seized and forfeited goods through arrests and prosecutions; and

WHEREAS, Section 16-13-702(1), C.R.S., provides that no forfeited property shall be used nor shall any forfeited proceeds be expended by a seizing agency unless such use or expenditure has been approved by a committee on the disposition of forfeited property; and

WHEREAS, Section 16-13-702(3) specifies the compensation of a Forfeiture Committee for a seizing agency such as the Montezuma County Sheriff s Department; and

WHEREAS, Section 16-13-702(6), C.R.S. requires that membership of said Committee be approved by the governing body that has the power to approve the budget of the seizing agency; and

WHEREAS, the budget for the Montezuma County Sheriff s Department is approved by the Montezuma County Board of County Commissioners;

NOW, THEREFORE, BE IT RESOLVED that Montezuma county’s committee for the Disposition of Forfeited Property for property seized by the Montezuma County Sheriff’s Department shall be comprised of the Montezuma County Sheriff or his/her designee, the District Attorney for the 22nd Judicial District or his/her designee, and a member of the Montezuma County Board of County Commissioners or his/her designee.
