RESOLUTION NO 22 – 2023

A Resolution Pursuant to C.R.S.30-20-601 et seq. Forming, Creating, And Establishing a Local Improvement District For The Chip Sealing of County Road 26.1 Loop Serving The Mesa Sky Estates Subdivision, And Providing for Payment Of The Costs For Said Improvements By Assessment Of Property

WHEREAS, pursuant to C.R.S. 30-20-603(3)(a), a petition for the chip and sealing of Montezuma County Road 26.1Loop serving the Mesa Sky Estates Subdivision located in Montezuma County, Colorado was presented to the Montezuma County Board of County
Commissioners; and

WHEREAS, the Petition requested that the chip and seal improvements be done
according to Montezuma County and State of Colorado road regulations and specifications in an economically efficient manner in a price not to exceed $131,400.00; and

WHEREAS, the Petition requested that the full initial cost of the improvements be paid for by Montezuma County and paid back over a ten-year period through a special assessment that would be assessed to all lot owners in the subdivision; and

WHEREAS, pursuant to C.R.S. 30-20-603(5), a preliminary order was made by the
Montezuma County Board of County Commissioners; and

WHEREAS, pursuant to C.R.S. 30-20-603(6), public notice having been given by the Montezuma County Clerk and Recorder to the owners of any property to be assessed; and the required public hearing having been held by the Montezuma County Board of County
Commissioners; and said Board having heard and determined all complaints and objections before final action;

NOW THEREFORE BE IT RESOLVED by the Montezuma County Board of County Commissioners as follows:

  1. That the Montezuma County Mesa Sky Estates Local Improvement District, is hereby formed, created, and established pursuant to C.R.S. 30-20-1 et seq. for the chip
    sealing of County Road 26.1 Loop serving the Mesa Sky Estates Subdivision.
  2. That the costs of the chip sealing of County Road 26.1 Loop totaling $131,400.00 be assessed over a ten-year period through a special assessment assessed to all lot owners in the Subdivision;
  3. That pursuant to C.R.S. 30-20-603(7),the Montezuma County Board of County commissioners finds that the above-described improvements to county Road 26’1 Loop were duly ordered after notice given and after hearing duly held, and that the proposal for same properly initiated by a Petition presented and subscribed by the required number of property owners, and the Montezuma County Board of County Commissioners heard all complaints and objections before taking the action described in this Resolution.
