RESOLUTION No. 8-2021

WHEREAS, the original resolution for School Land Dedication Fees was originally approved on July 10th, 2007 by the Montezuma-Cortez RE-1 School District Board of Education and adopted by the Board of County Commissioners on October 29, 2007;

WHEREAS, State Law (C.R.S. 30-28-133) allows the Board of County Commissioners, upon the request of Local Boards of Education, to acquire land or payment in lieu of land to be held for use and benefit of the owners and future owners in a proposed land development;

WHEREAS, the Montezuma Cortez School District RE-1 Board of Education has determined that any land development platted within its boundaries, which makes available building sites, homes, apartments, condominiums or mobile homes, will have an impact upon the district and for purposes of long range planning, site acquisition and building improvements thereon, has determined that wherever feasible it is in the best interest of the school district to obtain payment of money in lieu of the actual land dedication or conveyance of platted land within a subdivision;

WHEREAS, a flat fee of $1,043.85 will be assessed to land developments platted within the Montezuma-Cortez School District boundaries; and

WHEREAS, the Montezuma Cortez School District RE-1 Board of Education has amended and approved the adoption of the new flat fee as of the May 11, 2021, as attached. Montezuma-Cortez School District RE-1 School Land Dedication/Fee Resolution (Adopted 7/20/2021)

NOW THEREFORE BE IT RESOLVED that this Resolution is hereby adopted by the Board of County Commissioners and said School Land Dedication/Fee Resolution is so amended.
