At a regular meeting of the Board of Commissioners, Montezuma County, Colorado, held on Tuesday November 19, 2024 at the Montezuma County Administration building in Cortez, Colorado, there were present:

CHAIRMAN CANDELARIA opened the meeting of November 19, 2024 with the Pledge of Allegiance

 

MINUTES: Commissioner Koppenhafer moved to approve the Proceedings of the Board of County Commissioners of Montezuma County, held on Tuesday, November 12, 2024 as presented.  The motion was seconded by Commissioner Lindsay and carried.

 

PUBLIC HEARING: It being the time set aside a public hearing is held for review and determination a proposed 8 Lot Major Subdivision and AR3-9 Rezoning Application submitted by Kevin & Patricia Hale; agents: Jennifer Turner & Rachel Comisky, on property located at 30655 Road H, Cortez, CO, consisting of 36.05 acres, more or less, located east of Road 27, south of Hwy 160, situated in Section 34, Township 36N, Range 15W, N.M.P.M.  The roll was called, the public notice read, and the proceedings were recorded for the record.  Mrs. Comisky was present.  Planning Director, Don Haley along with Assistant, S. Jane Duncan presented the details of the application and the findings of the Planning and Zoning Commission.  Commissioner Candelaria opened the hearing to public comment.  Public comment was made by Billy Akers, Troy Jaskowski, Brian Davis, Robin Smith, Thomas Comisky, Brittany Martin, Kasey Bell and Joann Arutta.  Emails received from Kenneth Degener, Reid Tobin, Bill Akers, Doug Jennings, Robin Smith, and Troy Jaskowskie will be included in the record.  Hearing no further public comment that portion of the hearing was closed.  After hearing, all the evidence presented Commissioner Lindsay moved to continue the hearing to November 26, 2024 at 9:00 a.m.  Second by Commissioner Koppenhafer and carried.  (See attached)

 

PLANNING:  Planning Director, Haley along with Assistant, Duncan presented for discussion and approval of a Setback Variance Application, submitted by Seth Stephens, on property located at 16105 Road 18, Cortez, CO, consisting of 1.01 acres, more or less, located north of Road S and west of Road 18, situated in Section 21, Township 37N, Range 17W, N.M.P.M.  Commissioner Koppenhafer moved to deny the Variance Application, submitted by Seth Stephens, on property located at 16105 Road 18, Cortez.  Second by Commissioner Lindsay and carried.    (See attached)

 

Director, Haley along with Assistant, Duncan presented for signatures of a Special Use Permit, submitted by Daniel Quigley, on property located at 29554 Road N, Dolores, CO, consisting of 40 acres, more or less, located east of Road 29, north of Road M, situated in Section 9, Township 36N, Range 15W, N.M.P.M.

 

Planning Director, Haley along with Assistant, Duncan presented for signatures of a Mylar for Subdivision Amendment and Rezoning, to Lot #4 of the Bear Pond 4 Lot Moderate Subdivision, submitted by Ronnie & Rachel Hurst on property located at 16361 Road 30.7, Dolores, CO, consisting of 22.58 acres, more or less, located north of Hwy 184, east of Road 30.5, situated in Section 22, Township 37N, Range 15W, N.M.P.M.

 

SUPPLEMENTAL BUDGET REQUEST HEARING: From the Montezuma County Sheriff’s office, Undersheriff Tyson Cox, Detective Sgt. John Hargraves, Detention Lt. Vici Pierce, Admin Assistant Finance Kendall Allen, and Admin Supervisor Wanda Martin met with the Commissioners to discuss the supplemental budget requests for the Sheriff’s Departments.  Commissioner Lindsay moved to continue again the decision on the Sheriff’s office supplemental budget, to December 17.  Second by Commissioner Koppenhafer and carried.  (See attached) 

 

PUBLIC COMMENT: Public comment was made by Landan Wilson and Shawn Eddy

 

UNFINISHED BUSINESS:

 

INTERGOVERNMENTAL AGREEMENT: The proposed Intergovernmental Agreement between the City of Cortez and Montezuma County for the use of the Cortez Animal Shelter by the Sheriff’s Office was presented for approval.  Commissioner Koppenhafer moved to sign the Intergovernmental Agreement regarding the Animal Shelter services, effective on the first day of January 2025, between the City of Cortez and Montezuma County.  Second by Commissioner Lindsay and carried.    (See attached)

 

DISCUSSION:  Administrator Anderson presented the Sheriff’s Office organizational, financial and budget analysis proposal from KRW Associates LLC.  Commissioner Koppenhafer moved to accept the proposal for KRW Associates LLC to conduct an organizational financial and budget analysis at the Montezuma County Sheriff’s office.  Second by Commissioner Lindsay and carried.  (See attached)

 

DISCUSSION: A letter addressed to Montezuma County Sheriff Steve Nowlin and the Command staff, related to vehicle titles that are held at the Sheriff’s Office, was presented for approval.  Commissioner Koppenhafer moved to send the letter to Steve Nowlin and Command Staff at the Montezuma County Sheriff’s Office, requesting the titles to different vehicles that are in his possession.  Second by Commissioner Lindsay and carried.    (See attached)

 

DISCUSSION: The discussions related to the proposed Compassionate Leave Policy and the proposed 2025 Holiday Schedule were tabled until the next meeting.  

 

DISCUSSION: The Montezuma County Public Transportation (MCCO) proposed partial wraps for vehicles, were presented for approval.  Commissioner Koppenhafer moved to approve the partial wraps for the MOCO Transportation vehicles, as presented.  Second by Commissioner Lindsay and carried.  (See attached)

 

COUNTY ATTORNEY REPORT: County Attorney, Stephen Tarnowski introduced himself and then gave updates on the Ironwood case, the Dollar Store land use case, the Severance Tax lawsuit, the Unemployment Appeal case, the Sheriff’s habeas corpus case and reported that there were several child protection court appearances scheduled at the same time as the BOCC meetings.  Attorney Tarnowski and Administrator Anderson will work together to get the job announcement for the Assistant County Attorney position posted.

 

ADMINISTRATOR REPORT: County Administrator, Travis Anderson presented for approval, Transfer Order #6-2024, a transfer from Senior Citizens Bus Fund (89) to the General Fund (001) for reimbursement of the new Transportation Bus purchased from Davey Coach Sales Inc in the amount of $106,893.00.  Commissioner Koppenhafer moved to approve order #6-2024 a transfer from Senior Citizens Bus Fund to the General Fund for reimbursement of the new Transportation Bus, for $106,893.00.  Second by Commissioner Lindsay and carried.  (See attached) 

 

COUNTY COMMISSIONER REPORT: Topics within the Commissioners reports included:

Commissioner Lindsay: discussed the attended training and reported on the attended Cortez City Council meeting. 

Commissioner Koppenhafer reported on the attended Mancos Town meeting and the attended Southwest meeting.

Commissioner Candelaria: Discussed the attended training of State Statute, Board of County Commissioner absolute funding requirements and the Dolores NCA.

 

COUNTY CLERK & RECORDER: County Clerk, Kim Percell gave an update on the November 5, 2024 General Election.  

 

MOTION TO ADJOURN: Commissioner Koppenhafer moved to adjourn, seconded by Commissioner Candelaria and carried.

 

CORRESPONDENCE: The following correspondence was read and noted: the 2024 November Veterans Service Report.
