ORDINANCE NO. 1-2010
AN ORDINANCE PERMITTING THE LAWFUL
POSSESSION OF FIREARMS IN GOVERNMENT BUILDINGS OWNED BY MONTEZUMA COUNTY
WHEREAS, pursuant to C.R.S. § 30-11-101(2), the Montezuma County Board of County Commissioners have the duty and authority to provide for public health, safety and welfare may adopt ordinances to effectuate that duty; and
WHEREAS, pursuant to C.R.S. § 18-9-11 ?(a), the Board has the duty and authority to establish regulations to administer, protect, and maintain County buildings and property; and,
WHEREAS, the Montezuma County Board of County Commissioners are fully committed to upholding the Second Amendment of the United States Constitution and right to bear arms that the Second Amendment conveys;
WHEREAS, on May 7, 2024, the Colorado General Assembly passed Senate Bill 24-131 , which prohibits the carrying of firearms in sensitive places effective July 1, 2024; and,
WHEREAS, Senate Bill 24-131 shall create C.R.S. § 18-12-105.3, which prohibits the carrying firearms in government buildings; and,
WHEREAS, C.R.S. § 18-12-105.3(4)(b) permits counties to enact an ordinance that permits the lawful carrying of firearms in County buildings; and
WHEREAS, this Board believes that it is of vital importance to allow individuals who hold a valid permit to carry a concealed handgun in government buildings owned by Montezuma County unless otherwise prohibited by a law or lawful order of a law enforcement officer or any individual holding authority to issue such an order; and
WHEREAS, the authority of this Ordinance extends to all parts of Montezuma County, Colorado. This Ordinance is not intended to affect any restriction not expressly described in this Resolution, including those restrictions created by Senate Bill 24-131 and codified in C.R.S. §§ 18-12-105.5 and 1-13-724.
NOW THEREFORE BE IT ORDAINED by the Montezuma County Board of Commissioners that individuals shall be permitted to possess firearms in government buildings owned by Montezuma County, Colorado, including, but not limited to:
A. The chambers or galleries where Montezuma County’s governing body are located;
B. Any building owned by Montezuma County in which an official meeting of the Montezuma County Board of County Commissioners is taking place;
C. Any building in which the official office of any elected member of Montezuma County’s governing body is located.
