RESOLUTION NO 23 – 2023

A Resolution Amending Montezuma County Resolution No. 22-2023 which Formed, Created, and Established a Local Improvement District for the Chip Sealing of County Road 26.1 Loop Serving The Mesa Sky Estates Subdivision


WHEREAS, Montezuma County Resolution No.22-2023 was signed and adopted on October 2, 2023; and
WHEREAS, Montezuma County Resolution No.22-2023 formed, created, and established a Local Improvement District pursuant to C.R.S. $ 30-20-603(3Xa) for the chip sealing of Montezuma County Road 26.1 Loop Serving the Mesa Sky Estates Subdivision; and
WHEREAS, Montezuma County Resolution No.22-2023 failed to rely on the final Petition that was submitted by landowners requesting the creation of the Local Improvement District described above; and
WHEREAS, the Final Petition (attached as Exhibit 1) requested that the chip and seal improvements of County Road 26.1 Loop were not to exceed a total price of $ 150,000; and
WHEREAS, the final costs of the chip and seal improvements of County Road 26.1 Loop totaled $144,000.00. See Invoice attached as Exhibit 2; and
WHEREAS, pursuant to C.R.S. 30-20-603(5), a preliminary order was made by the Montezuma County Board of County Commissioners indicating that the $144,000.00 would be assessed over a seven (7) year period through a special assessment to all lot owners in the Sky Mesa Subdivision; and
WHEREAS, it was contemplated by the Montezuma County Board of County Commissioners that lot owners in the Sky Mesa Subdivision would be assessed a reasonable interest rate on the total costs of the improvements;
NOW THEREFORE BE IT RESOLVED by the Montezuma County Board of County Commissioners as follows:

  1. That the Montezuma County Mesa Sky Estates Local Improvement District, which was created by Montezuma County Resolution No.22-2023, which is incorporated into this
    Resolution by reference, be amended as follows:
  2. That the costs of the chip sealing of County Road 26.1Loop totaling $144,000.00 be assessed over a seven-year period through a special assessment assessed to all lot owners
    in the subdivision;
  3. That an annual interest rate of four (4) percent on the amount owned assessed to all lot owners in the subdivision;
