A RESOLUTION DECLARING MONTEZUMA COUNTY’S INTENT TO
REQUIRE AMBULANCE SERVICES TO OBTAIN A ‘LOCAL
AUTHORIZATION TO OPERATE’ PRIOR TO OPERATING WITHIN
THE COUNTY’S JURISDICTION


WHEREAS, ambulance services have historically been regulated by the County
pursuant to C.R.S. § 30-11-107(1)(q); and


WHEREAS, SB 22-225 transfers regulatory authority to the State of Colorado and
requires ambulance service providers to obtain a license from the Colorado Department of Public
Health and Environment to operate on and after July 1, 2024; and


WHEREAS, SB 22-225 provides that a boards of county commissioners for the “local
authorizing authority in which the ambulance service operates or seeks to operate can require
ambulance services operating on a regular basis within the local jurisdiction to obtain a “local
authorization to operate” prior to operating; and
WHEREAS, SB 22-225 authorizes counties to establish necessary requirements that
ambulance services must adhere to prior to receiving local authorization to operate; and


WHEREAS, SB 22-225 allows counties to limit the number of ambulance services that
will be authorized to operate within the county’s jurisdiction; and


WHEREAS, the Montezuma County Board of County Commissioners have a statutory
duty pursuance to C.R.S. § 30-11-101 (2) to provide for the public health, safety, and welfare and
may adopt resolutions to effectuate that duty; and


WHEREAS, ensuring that safe and reliable ambulance services are operating in
Montezuma County is paramount to providing for the public health, safety, and welfare of the
citizens of Montezuma County.


NOW THEREFORE, BE IT RESOLVED by the Montezuma County Board of County
Commissioners that:


1. Pursuant to SB 22-225 and the will of the Montezuma County Board of County
Commissioners, ambulance services shall not be allowed to operate within
Montezuma County’s jurisdiction absent local authorization.


2. No more than one ambulance service may receive local authorization to operate
within Montezuma County’s jurisdiction at any one time.


3. In order to be considered to obtain local authorization to operate within Montezuma
County’s jurisdiction, ambulance services must fulfil the requirements and adhere to the processes outlined in the ‘·Process to obtain local authorization to operate
ambulance service in Montezuma County:· which is attached to this Resolution as
Exhibit A.


4. Final local authorization for an ambulance service to operate within Montezuma
County’s jurisdiction must be approved by the Montezuma County Board of County
Commissioners.

Process to obtain local authorization to operate
ambulance service in Montezuma County


1. Montezuma County Public Health Department will provide copies of
the Minimum Equipment Requirements/Checklist and Application to
the agency ambulance coordinator.


2. Following completion of the forms, the Montezuma County Medical
Officer performs an inspection and review of the vehicles and signs
off on the form.


3. The applying agency will return the forms to Montezuma County
Public Health Department for final review.


4. Once final review is complete, local authorization may be to the
applying agency.
